This isn't quite the knockout punch for EULAs I thought it might be. It seems that Uber's side was thrown out because the actual agreement was through a link to a web page, something that by no means we can assume the user would follow and load and read. Edit: This definitely does punch out on-disc-EULAs though. You know, 'installation of the software on this disc means you agree to the terms on www.ouropinionofyourrights.blah'

Uber to react by making users listen to an audio version of their TOS before they can use the app.
