This isn't quite the knockout punch for EULAs I thought it might be. It seems that Uber's side was thrown out because the actual agreement was through a link to a web page, something that by no means we can assume the user would follow and load and read.
Edit: This definitely does punch out on-disc-EULAs though. You know, 'installation of the software on this disc means you agree to the terms on www.ouropinionofyourrights.blah'
